TERMS OF USE & CONDITIONS

1. Introduction and Acceptance of Terms

These Terms of Use and Conditions ("Terms") govern access to and use of the website www.108luxury.com, any 108 Luxury mobile application, and the physical retail/experience store(s) operated under the brand "108 Luxury" (together, the "Platform"), owned and operated by Mischelle Manna Lucas, a sole proprietorship having its registered address at Row House 7, Moraya Residency Phase 1, Pashan, Sus Road, Opposite Abhinav College, Pune, Maharashtra 411021, India ("108 Luxury", "we", "us", "our").

By accessing the Platform, creating an account, placing an order, or visiting our physical store, you ("User", "Customer", "you") agree to be bound by these Terms, our Privacy Policy, and our Refund, Return & Exchange Policy, each of which is incorporated herein by reference. If you do not agree with any part of these Terms, please discontinue use of the Platform immediately.

2. Definitions

• "Platform" means the website, mobile application, and physical store(s) through which 108 Luxury offers products.

• "Products" means perfumes, fragrances, attars, gift sets, and related accessories sold under the 108 Luxury brand.

• "Order" means a confirmed request placed by a User to purchase Products.

• "Content" means text, graphics, logos, images, product descriptions, and other material appearing on the Platform.

3. Eligibility

Use of the Platform and purchase of Products is open only to persons who are competent to contract under the Indian Contract Act, 1872, including persons who are at least 18 years of age. By using the Platform, you represent and warrant that you meet this eligibility requirement. If you are using the Platform on behalf of a minor or a person lacking legal capacity, you do so as their guardian and accept full responsibility for such use.

4. Nature of Business

108 Luxury sells fragrance and allied products both online through the Platform and offline through its physical retail location(s). These Terms apply to purchases made through either channel unless a specific in-store policy is separately displayed and communicated at the point of sale, in which case the in-store policy shall prevail for that transaction only.

5. Account Registration

You may be required to create an account to place an Order. You agree to provide accurate, current, and complete information during registration and to keep such information updated. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. 108 Luxury shall not be liable for any loss arising from unauthorised use of your account.

6. Product Descriptions, Pricing, and Availability

1. All Products are described as accurately as possible; however, fragrance perception, colour, and packaging may vary slightly from images displayed on the Platform due to screen settings, batch variation, or natural variation in raw materials.

2. Prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. Prices are subject to change without prior notice; however, the price applicable to an Order already confirmed shall not change.

3. 108 Luxury reserves the right to limit quantities, discontinue Products, or refuse/cancel an Order at its discretion, including in cases of suspected fraud, pricing errors, or stock unavailability, with a full refund issued where payment has already been made.

7. Order Placement, Confirmation, and Cancellation

An Order is confirmed only upon receipt of an order confirmation (via email/SMS/app notification) from 108 Luxury. A confirmation of receipt of your Order does not constitute acceptance; 108 Luxury reserves the right to accept or decline any Order at its sole discretion prior to dispatch. Orders may be cancelled by the Customer prior to dispatch by contacting us at lucas.satyendra@gmail.com; once an Order has been dispatched, cancellation requests will be treated in accordance with the Refund, Return & Exchange Policy.

8. Payment Terms

Payments may be made through the payment methods made available on the Platform, including credit/debit cards, UPI, net banking, and other third-party payment gateways, or in cash/card at the physical store. All online payments are processed through secure, PCI-DSS compliant third-party payment gateways; 108 Luxury does not store your complete card or payment credentials on its own servers. You agree to provide valid and accurate payment information.

9. Shipping and Delivery

Shipping timelines communicated on the Platform are estimates and not guaranteed delivery dates. 108 Luxury shall not be liable for delays caused by courier partners, force majeure events, incorrect address details provided by the Customer, or circumstances beyond its reasonable control. Risk in the Products passes to the Customer upon delivery to the address provided at the time of Order.

10. Intellectual Property

All Content on the Platform, including the "108 Luxury" name, logo, trademarks, product formulations, packaging design, photography, and website design, is the exclusive property of Mischelle Manna Lucas, trading as 108 Luxury, and is protected under applicable Indian intellectual property laws, including the Trade Marks Act, 1999 and the Copyright Act, 1957. No Content may be copied, reproduced, republished, or used for commercial purposes without prior written consent from 108 Luxury.

11. User Conduct

While using the Platform, you agree not to:

• Use the Platform for any unlawful purpose or in violation of these Terms;

• Post or transmit any content that is defamatory, obscene, or infringing of third-party rights;

• Attempt to gain unauthorised access to the Platform, its servers, or connected databases;

• Engage in fraudulent transactions, including use of stolen payment instruments;

• Reproduce, duplicate, copy, or resell any part of the Platform or Products without authorisation.

12. Reviews and User-Generated Content

Any reviews, ratings, images, or comments you submit must be truthful, non-defamatory, and free of unlawful content. By submitting such content, you grant 108 Luxury a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display it for marketing and promotional purposes. 108 Luxury reserves the right to remove any content it deems inappropriate.

13. Third-Party Links

The Platform may contain links to third-party websites or services (including payment gateways and social media). 108 Luxury does not control and is not responsible for the content, policies, or practices of any third-party website.

14. Disclaimer of Warranties

The Platform and Products are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, 108 Luxury disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, save for statutory rights available to consumers under the Consumer Protection Act, 2019.

15. Limitation of Liability

To the maximum extent permitted under applicable law, 108 Luxury's aggregate liability arising out of or relating to these Terms or any Order shall not exceed the amount actually paid by the Customer for the relevant Order. 108 Luxury shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits or data, arising from use of the Platform or Products.

16. Indemnification

You agree to indemnify and hold harmless 108 Luxury, its proprietor, employees, and agents from and against any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms, misuse of the Platform, or violation of any applicable law or third-party right.

17. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information, and is incorporated into these Terms by reference.

18. Refunds, Returns, and Exchanges

All Orders are subject to our separate Refund, Return & Exchange Policy, which forms part of these Terms. Please note that, in accordance with hygiene and safety standards applicable to cosmetic and fragrance products, opened or seal-broken Products are generally not eligible for return except in cases of proven defect or damage, as further detailed in that policy.

19. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Subject to the dispute resolution mechanism below, the courts at Pune, Maharashtra shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms.

20. Dispute Resolution

In the event of any dispute, controversy, or claim arising out of or relating to these Terms, the parties shall first attempt to resolve the dispute amicably through good-faith negotiation for a period of thirty (30) days. Failing such resolution, the dispute shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, with a sole arbitrator appointed by mutual consent, and the seat and venue of arbitration shall be Pune, Maharashtra. This clause shall not affect the Customer's statutory rights to approach the appropriate Consumer Forum under the Consumer Protection Act, 2019.

21. Force Majeure

108 Luxury shall not be held responsible for any delay or failure to perform its obligations under these Terms where such delay or failure results from causes beyond its reasonable control, including natural disasters, pandemics, strikes, government action, or courier/logistics disruptions.

22. Amendments

108 Luxury reserves the right to modify, amend, or update these Terms at any time. Material changes will be notified through the Platform. Continued use of the Platform after such changes constitutes acceptance of the revised Terms. Users are encouraged to review these Terms periodically.

23. Severability

If any provision of these Terms is held to be invalid or unenforceable by a competent authority, the remaining provisions shall continue in full force and effect.
